Question by SciFiGuy: Advice for a non-typical Forged Prescription charge in California (Lymes Disease)?
First off we are law abiding people overall, not random dirt bags… Ok, my girlfriend and I live in Massachusetts, she lived in California 2 years ago then moved here. We found out by chance last week that she has an open warrant in Cali for forging prescription drugs. The deal is that she has Lymes Disease, she was desperate for antibiotics and altered a script a few years ago for more refills than they’d give her, as she had to see 3 different Dr.s just to get the Rx in the first place.

All the info I’m seeing on forged scripts are for people fudging Percocet or Oxicontin or whatever in order to abuse or sell them. I don’t see any cases about someone ‘stealing’ antibiotics with zero street value in order to get better. Is it likely she’ll receive a lighter sentence or have it dismissed entirely? She has ~plenty~ of documentation of Dr. visits and Rx for both here and Cali and the drug she ‘stole’ has no known recreational effects and is probably worth less than her Co-pay in street value so no one can argue it was for pleasure or profit. Is the court more likely to take pity on a girl trying to get herself healthy or blindly throw the book?
