Here is a link that gives the background and citing. Ask any judge and this is an abomination that may in the long run even out sentencing across the board. But this system takes away from the judge the ability to enter mitigation into sentencing. Judges need to judge not just check off a list.

Good luck… you’d be better off arguing that it is NOT a disease. It is (IMHO) an addiction like drugs and cigarrettes and food…
